Terms of sale

In force as of November 5, 2026

These terms govern the purchase of the PFCD-MNT training on the Kuishi Learn platform. Please read them before paying: by paying, you accept them.

1. Purpose

These terms of sale (the "Terms") govern the purchase of access to the Clinical Training Program in Dietetics for Non-Communicable Diseases (PFCD-MNT, the "Training") on the Kuishi Learn platform, elearning.kuishismart.org (the "Platform").

They apply to every purchase made on the Platform. By paying, the learner ("you") confirms having read and accepted them.

2. The seller

The Training is sold by KUISHI SMART, a not-for-profit corporation incorporated under the Canada Not-for-profit Corporations Act, corporation number 1046688-3, with its registered office at 40 Sylvan Valley Way, Toronto, Ontario M5M 4M5, Canada.

Email: info@kuishismart.org · Phone: +1 647 528 6034.

3. Definitions

Learner: the person who buys access to the Training and is its sole user.

Account: the learner's personal space on the Platform.

Training: all the content and activities described in section 4.

Certificate: the document issued to a learner who meets the conditions of section 9.

4. The Training

The purchase gives online access to all the modules of the PFCD-MNT program, to the graded quizzes and final exams, to the live sessions with the trainers according to the schedule published on the Platform, and to verifiable certificates under the conditions of section 9.

The content may be updated to stay in line with scientific knowledge and good practice. These updates do not reduce the Training described above.

5. Account and access

A purchase requires an Account. You agree to provide accurate information and to keep it up to date.

You must be at least 18 years old, or have the permission of a parent or guardian.

Access is strictly personal. Your login details must not be shared with anyone. The Account may not be shared, transferred or resold.

To follow the Training, you need a recent computer, tablet or phone, an internet connection and a valid email address. This equipment and the connection are at your own cost.

6. Length of access

Access to the Training is open with no time limit from the confirmation of payment, for as long as the Training is offered on the Platform.

7. Price

The price of the Training is CA$1,250, all taxes included.

It is a one-time payment. There is no subscription and no automatic renewal.

For a mobile money payment, the amount is charged in US dollars. It is the price in Canadian dollars converted at the official daily exchange rate published by the Bank of Canada, rounded to the dollar. The amount shown when you confirm the payment is the amount due.

Kuishi Smart may change its prices at any time. The price that applies is the one shown at the time of payment.

8. Payment

Accepted payment methods are bank card (Visa, Mastercard), on the secure payment page of the provider Stripe, and mobile money in the Democratic Republic of the Congo (M-Pesa, Airtel Money, Orange Money), through the provider PawaPay, confirmed with a PIN code on your phone.

Payment data is processed directly by these providers. Kuishi Smart neither receives nor stores your card or mobile money account details.

Any fees charged by your bank or operator (currency conversion, transaction fees) remain at your cost.

Access to the Training opens automatically once the payment is confirmed. If your access is not open within 24 hours of a confirmed payment, write to info@kuishismart.org.

9. Certificate

The Certificate is issued to a learner who has completed all the modules and passed the final exams according to the criteria shown on the Platform.

The Certificate confirms participation in and success at the Training. It is not a degree, a professional title or a licence to practise dietetics or nutrition. The right to practise falls under the professional order or competent authority of each country or province.

Payment does not guarantee that the Certificate will be obtained.

10. Disclaimer

The Training content is for educational purposes. It does not replace medical advice, diagnosis or treatment by a qualified health professional. The learner alone is responsible for how they use the knowledge acquired, in line with the rules that govern their practice.

11. Live sessions

Live sessions take place according to the schedule published on the Platform. Kuishi Smart may change their dates, times or speakers; changes are announced on the Platform. A session missed by the learner gives no right to a refund.

12. No refunds

All sales are final. No refund, full or partial, is granted once the payment is confirmed, including if the learner does not start, follow or finish the Training.

The only exception: if a payment was made twice or an amount was charged in error, the overpaid amount is refunded on request to info@kuishismart.org.

This section applies subject to any consumer rights under applicable law that cannot be waived.

13. Payment disputes

Before disputing a payment with your bank or operator, write to info@kuishismart.org: most problems are solved this way. A dispute opened without a valid reason leads to access to the Training being suspended while it is handled.

14. Suspension and closure of the Account

Kuishi Smart may suspend or close the Account, without refund, in case of sharing of the Account or login details, copying, distribution or resale of the content, payment fraud or attempted fraud, disrespectful behaviour towards trainers or other learners, or any other serious breach of these Terms.

Except in an emergency, the learner is first warned by email.

15. Intellectual property

The Training content (texts, videos, images, quizzes, documents, exams) belongs to Kuishi Smart or its trainers and is protected by copyright. It is for your personal use to follow the Training. Any copying, reproduction, distribution, posting online or resale, in whole or in part, is forbidden without the written consent of Kuishi Smart.

16. Platform availability and liability

Kuishi Smart strives to keep the Platform available at all times, but cannot guarantee that there will be no interruptions, in particular for maintenance, updates or technical failures.

Kuishi Smart is not responsible for access problems caused by your equipment, your internet connection or your operator.

In all cases, Kuishi Smart's liability is limited to the amount paid for the Training.

17. Force majeure

Kuishi Smart is not responsible for a delay or failure caused by an event beyond its reasonable control (natural disaster, general internet or power outage, decision of the authorities, conflict, epidemic).

18. Personal data

Kuishi Smart collects the data needed to create the Account, follow the Training and issue the Certificate. How it is handled is described in our privacy policy: kuishismart.org/en/privacy.

19. Changes to the Terms

Kuishi Smart may change these Terms. The version that applies to a purchase is the one in force at the time of payment.

20. Language

These Terms are written in French and English. If the two versions differ, the French version prevails.

21. Complaints and disputes

Any complaint must first be sent by email to info@kuishismart.org. Kuishi Smart undertakes to reply within 10 business days.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Failing an amicable agreement, disputes fall under the competent courts of the Province of Ontario, subject to the mandatory rules that protect consumers where they live.
